Prenuptial and Postnuptial Agreements

In California, the use of a prenuptial or postnuptial agreement can allow you to avoid California's community property laws, establishing your own terms for the distribution of property in the event of divorce. However, you must comply with the requirements set forth in California law, or the agreement will not be valid. To be enforceable, a prenuptial / postnuptial agreement must:

  • provide a 7-day review period before it must be signed
  • fully disclose all debts and assets

California law also requires that both parties to these contracts must be represented by counsel or be encouraged to do so. A prenuptial / postnuptial agreement can also state that spousal support will not be paid. In the absence of such a provision, temporary or permanent support may be sought. Importantly, child support obligations cannot be contracted away.

Though postnuptial agreements are not as common as prenuptial agreements, they can still be enforceable and can help you avoid the loss of property, as well as responsibility for the debt of a spouse.
